In the May 1980 issue of this journal, Mercuro and Ryan (M-R) applied some graphical concepts from welfare economics to the Samuels-Buchanan discussion of Virginia's Cedar Rust statute. While M-R's approach is an innovative and educational way of viewing this exchange, their analysis suffers from a technical error which distorts the choice that was to be made in deciding whether or not to enact such a statute. The purpose of this comment is to correct this error and to pursue, in the same vein as M-R, the proper characterization of this policy problem.
