Abstract

Under the National Environmental Policy Act of 1970, corporations planning to construct largescale facilities are required to receive project approval by a designated federal agency. Decisions are based upon an assessment of anticipated impacts in an environmental impact statement. The traditional approach to seeking project approval promotes adversity and has been the source of litigation, delay, and expense for the project applicant. A highly acclaimed alternative approach, involving cooperation rather adversity, was used by U.S. Steel in seeking approval for its proposed $ 4-billion Lakefront steel mill. The author suggests a means for choosing between the two strategies.
