Improving the management functions of state and local governmental bodies – is the best way to social protection of children without parental care in Ukraine

The main aspects, implementation of social and legal protection of children without parental care by state and local bodies have been investigated; the basic reasons that lead to improper performance of duties by authorized bodies and services have been considered in this article. At the some time, with the political economic problems that need urgent solution in Ukraine, as well as in most countries, there is a problem that not only reduces its relevance, but directly or indirectly dependents on socio-economic factors in society. This problem is implementation of social protection of children; especially the most urgent problem is social protection of children without parental care. The aim of this article is to analyses the main aspects, improving functions, of social and legal protection of children without parental care by executive authorities and local bodies. Despite the measures taken by the state and a slight decrease in the judgments of deprivation of parental rights impact on the amount of children without parental care is not full, and social and legal protection of childhood in Ukraine is ineffective. In addition, the range of existing measures do not fully meet the needs of people who are in difficult circumstances, which encourages the active use of institutional care, while one of the objectives is to ensure deinstitulisation and to supply living in the community. The available human resources should be directed to implement more effective measures at the community level. The reasons which at present, prevent effective cooperation of local bodies and executive authorities in the field of social and legal protection of children include: unclear line between the local bodies and local state administrations; inefficient mechanism of interaction between the branches of public authority; lack of clear division of responsibility between local bodies at various levels; underestimation of the impact of civil society on the process of problem children’s adaptation. Therefore, the problem of decentralization, improvement of public management mechanisms of social and legal protection of children without parental care, including institutional mechanism is very relevant and directly related to systemic reforms and transformation processes taking place in the country.
