LEGAL CONSIDER ON PERFECTING RURAL LAND CONTRACT MANAGEMENT SYSTEM IN CHINA
分析了土地承包经营立法面临的若干问题，提出应明确土地承包经营权的物权属性，并遵循公平优先兼顾效率的原则赋予农民保障性土地权利。
To adapt to the legal demand of rural land system reform,resove some new problems of land contract management system which has been put in practice for more than twenty years,then to radically resolve the Agriculture,Country and Peasantry Problem to ensure farmer's right,China must reform and perfect land contract management system farther.Starting with land contract management right,this paper analyzes several problems faced land contract management lawmaking,then puts forward some advices,such as to define the real right character of land contract management right,to endow with farmer indemnificatory land right according to the legislation principle that equity first then efficiency to two or more thing.
