On the Legal Regulation of the Reduction and Utilization of the Construction Waste Based on Eco-Efficiency
本文以生态效率为评估工具，分析了我国建筑垃圾管理在立法理念、监管体系、具体制度和法律责任等方面的不足，并借鉴美、德、日等国的经验，提出完善建筑垃圾减量化和资源化利用法律体系的必要性。
Eco-efficiency is an assessment tool based on the relationship between environmental system and economic system,including economic efficiency and environmental efficiency.Along with the fast urbanization in our country,the construction waste is increasing rapidly.A large amount of construction waste is inefficiently used,which doesn′t conform to the requirements of the principle of ecological efficiency and brings serious environment and resource issues.Compared with the United States,Germany,Japan and other developed countries,our country is backward in many aspects in the management of construction waste,such as,the backward legislation idea,the lack of special legislation,the unreasonable supervision system,the imperfect specific system and the unclear legal liability.Under the guidance of the principle of eco-efficiency,it is imperative to perfect the legal system of the management of construction waste from the reduction and reuse of the construction waste.
