On Export Inspection Systm of Customs Protection of Intellectual Property Right in China
本文分析了中国海关知识产权出口检查制度因美国压力而建立的历史背景，指出立法缺乏实践积累且超前于经济发展，建议取消该制度并修改相关法规，以实现保护权利人与社会公众、促进国际贸易自由流通之间的利益平衡。
The export inspection system of customs protection of intellectual property in China was established because of american pressure. Due to specific historical background,the Chinese legislation is short of accumulation of practice and careless of development reality of economy and science technology,so it even surpasses the world level. It argues to achieve benefit balance between protection owners to th largest extent and social public,and between protection intellectual property and promotion free circulation of international trade in light of particular condition of our country and puts forward some suggestions to cancel export inspection system and amend 〈Regulation on Customs Protection of Intellectual Property Right〉.
