The Dilemma of Maintaining Legal Rights of Urban Homeowners
研究了城市业主集体维权中因激励机制缺失、力量失衡和诉讼制度缺陷导致的集体行动困境，并提出建立激励机制、赋予业委会诉讼主体资格等对策。
Collective disputes of urban homeowners have become the most important forms of collective disputes in city.However,they often face the dilemma of collective action such as power insufficiency and legal framework repelling because of lacking of incentive mechanism,unbalance of strength and the flaw of lawsuit system.In order to go out the difficult position,we can establish incentive mechanism at choice,give owners committee qualification of litigant,mature coordinative mechanism between representative of lawsuit and litigant,and construct diversified system of solving disputes for homeowners.
